Egypt: Surge of Military Trials

Al-Sisi’s administration is methodically reversing the reforms achieved in 2011, while the United States and other governments resume arming the government as if none of it matters.

(New York) – Egyptian authorities have referred hundreds of civilians to military courts based on an October 2014 decree by President Abdel Fattah al-Sisi. At least 820 civilians have been referred to military prosecutors in the past six weeks based on the unprecedented extension of military court authority, according to news reports compiled by Human Rights Watch.

Civil prosecutors have used the October decree retroactively, referring cases of civilians already under investigation or facing trial in civilian courts to military jurisdiction. Some had been released on bail by civilian courts.

“Curtailing the use of military courts to try civilians was one of the few tangible gains of the 2011 revolution, but that’s out the window now,” said Sarah Leah Whitson, Middle East and North Africa director. “Al-Sisi’s administration is methodically reversing the reforms achieved in 2011, while the United States and other governments resume arming the government as if none of it matters.”

Egypt’s military courts operate under the authority of the Defense Ministry, not the civilian judicial authorities. The judges are serving military officers. Military court proceedings typically do not protect basic due process rights or satisfy the requirements of independence and impartiality of courts of law. Children can fall under the jurisdiction of military courts, which Human Rights Watch opposes under any circumstances.

On December 15, 2014, the Supreme Guide of the Muslim Brotherhood, Mohamed Badie, and other top leaders of the group, including Mohamed el-Beltagy, Essam el-Erian, and Safwat Hegazy, were among 310 defendants whose cases were transferred by the general prosecutor in the city of Ismailia. They had been on trial for rioting and inciting violence leading to the torching of the Ismailia Courts Complex in August 2013. The Egyptian authorities labeled the opposition Brotherhood a terrorist group in December 2013.

On the same day, prosecutors referred another 40 alleged supporters of the Brotherhood, to the Ismailia military court. They face charges arising from their alleged role in protests, inciting violence, and blocking roads. Eight of nine women and girls among the defendants are secondary school or university students who have been free on bail for several months. They now face possible re-arrest. Human Rights Watch could not confirm the ages of all defendants, but military courts in Egypt, unlike civilian courts, do not differentiate in their treatment ofchildren and adults.

On December 13, 2014, Egypt’s prosecutor general referred 439 people for trial by a military court on charges linked to their alleged participation in deadly violence that broke out after the military’s removal of former president Mohamed Morsy in 2013. Of the 439, 139 had been facing trial before an ordinary criminal court in the Minya governorate, while the others were being tried by an ordinary court in Beheira governorate. On December 4, 2014, the chief prosecutor of Menoufia governorate referred 26 men, including six students, to military prosecutors. They face charges of rioting and belonging to a banned organization – the Muslim Brotherhood.

In November, a Cairo criminal court judge referred five al-Azhar University students for trial by a military court because, he said, President al-Sisi’s decree meant that his court “lacked jurisdiction” to try the students who were accused of torching the university's control room in January. Another 11 alleged Brotherhood supporters in the Kafr al-Sheikh governorate were referred to military court trials on charges that relate to events in August. Six of them were accused of disrupting railway tracks, and the other five were accused of planting a bomb in a court.

President al-Sisi issued the October decree, Law 136 of 2014, in the absence of an elected parliament. The decree places all “public and vital facilities” under military jurisdiction for the next two years. Article 2, which officials are using to give the law retroactive effect, requires state prosecutors to refer any crimes committed at those venues to their military counterparts.

The Egyptian Observatory for Rights and Freedoms, a local-based activist group, on December 16 made public photocopies of a November 11 decision allegedly by Prosecutor General Hisham Barakat requiring prosecutors throughout the country to “compile and send any cases related to aforementioned crimes, at any stage (of investigations), to military prosecutors whenever asked to do so.” Article 95 of the Egyptian Constitution stipulates that penalties may “only be imposed for acts committed after the effective date of the law imposing it.”

“Militarizing the trials of civilians, including children, is taking Egypt in the wrong direction, and doing so retroactively compounds the abuse,” Whitson said.

The African Commission on Human and Peoples’ Rights, in interpreting the African Charter on Human and Peoples’ Rights (to which Egypt is a state party), has said that military courts “should not, in any circumstances whatsoever, have jurisdiction over civilians.”

According to article 93 of the Egyptian Constitution, the international human rights agreements, covenants, and conventions to which Egypt is a state party have the force of law.

Ahmed Helmy, a lawyer who has represented defendants before military courts in multiple cases, told Human Rights Watch that he believes that the authorities are acting unconstitutionally by retroactively applying the decree.

“President al-Sisi should repeal his October decree before more damage is done if he has any concern for preserving Egypt’s reputation and the new constitution he has sworn to protect,” Whitson said. “He should also annul all verdicts against civilians that military courts have handed down since his government took power and order their retrial before civil judges.”

Saudi king grants Sisi medal of honour

Saudi's King Abdallah presented Egypt's President Abdel Fatah Al-Sisi with the highest medal of honour in the Kingdom during their meeting in Jeddah yesterday.

The visit by Al-Sisi is his first to the Kingdom since he assumed office on June 8. During the trip the leaders discussed bilateral relatios and issues of mutual concern, especially the developments in Gaza, Anadolu reported.

The two sides are expected to discuss the preparations for the donors' conference for Egypt, promised by the Saudi king and endorsed by the United Arab Emirates.

A day before his trip to the Kingdom, Al-Sisi called for the formation of an "Arab Alliance" to counter the danger of the Islamic State in Iraq and Sham (ISIS) which has seized control of vast swaths of Iraq and Syria.

Following the military's ouster of President Mohamed Morsi in July last year, Gulf countries were quick to lend support to the new regime, led by Al-Sisi. Gulf aid to Egypt since Morsi's ouster amounted to $15.9 billion, including $6.9 billion from the UAE, $5 billion from Saudi, and $4 billion from Kuwait.

Following his visit to Saudi, Al-Sisi is scheduled to pay a brief visit to Russia tomorrow based on an invite from Russian President Vladimir Putin.

Erdogan criticises Gul for congratulating Al-Sisi: We do not congratulate coups

Turkish Prime Minister Recep Tayyip Erdogan has criticised his country's president, Abdullah Gul, in front of EU ambassadors in Turkey.

The criticism came during a meeting between Erdogan and EU ambassadors over dinner, when Erdogan criticised Gul's congratulations for Abdel Fattah Al-Sisi, the leader of the recent coup in Egypt, upon his assumption of the post of the presidency. Jordan' s As-Sabeel newspaper quoted Erdogan as saying: "I must be honest, this congratulations to me holds no meaning, because it is not possible to offer congratulations to a coup leader."

Erdogan said that Egypt still plays a pivotal role in the future of the Middle East, expressing his wishes for Egypt and its people to enjoy actual democracy and stressing that his government's attitude towards Egypt stems from this point.

He added that Egypt's legitimate president, Mohamad Morsi, who came to power after winning a popular election with 54 per cent of the vote, was deliberately isolated to allow the army to bring about a military coup against a democratically elected government.

Erdogan stressed that the Turkish position has not changed on the issue of Egypt, and he criticised those countries that are avoiding calling what happened in Egypt a coup and accepting what he called the recent non-transparent sham of an election.

Syrian Brotherhood condemns letter to Al-Sisi

The Syrian Muslim Brotherhood has slammed the leader of the opposition coalition for sending a congratulatory letter to Egypt's coup leader and president, Abdel-Fattah al-Sisi. In rejecting Ahmad al-Jarba's letter to Sisi, the Brotherhood referred to the new president of Egypt as "the commander of the military coup against legitimacy." It pointed out that people in Syria "revolted for the sake of freedom" so "we do not accept congratulating tyrants."

The leader of the Syrian National Coalition of Revolutionary and Opposition Forces, Ahmad al-Jarba sent a letter to Sisi on Monday to congratulate him on his recent inauguration as president. He expressed his hope that cooperation with Egypt will be enhanced under Sisi's leadership and that Egypt will play an effective role in fulfilling the aspirations of the Syrian people.

The Brotherhood, however, regard such congratulations as "contrary to what has been agreed upon among the members of the national coalition, including respect for democracy and the peaceful transfer of power, which jeopardises the coalition's reputation and its future."

The Syrian revolution, it continued, has been based on a number of principles endorsed by the opposition, including "fighting against dictatorship and tyranny" with a quest for" freedom, justice and human rights" The results of elections, insisted the movement, should be upheld and respected.
The statement came the day after the former Comptroller General of the Muslim Brotherhood in Syria, Ali Bayanouni, announced that he has submitted his resignation from the Syrian opposition coalition.

Egypt's Anti-Coup National Alliance Calls "The Generals Think It's a Fiefdom" week of revolutionary action starting Friday June 6

To honor our pledge to the martyrs of the Revolution, we say to all Egyptians…

Sixty years of military rule in this country brought to Egyptians only desolation and destruction, poverty and widespread corruption, 'fiefdom' mentality and the loss of national independence. The traitorous commanders did not understand the message of the January 25 Revolution.


They executed the illegitimate military coup to undermine the Revolution and sabotage its gains. They toppled the first elected civilian president who came through legitimate measures – free and fair elections – in an evidently democratic atmosphere.


They brought in another military ruler, one of the vassals of the Zionist American lobby and the West – made president in a completely illegal fraudulent farce elections, which was certainly null and void, boycotted by the vast majority of Egyptians. This failed military usurper of power will not last long. The ruinous coup will ultimately fail, God willing. Egypt will not be ruled by a traitorous murderer who divides the people and sets up gangs of corruption and private fiefdoms in each and every establishment.


The Anti-Coup Pro-Legitimacy National Alliance continues to meet the call of the people… until victory, believing that the future is for us all together, determined by all the revolutionaries. The Alliance solemnly appreciates the people's great determination to honor their pledge to the martyrs and to secure the success of the third revolutionary wave in 2014, demonstrated in the successful boycott of the sham elections.


Furthermore, the Alliance deeply appreciates the legitimate President Mohamed Morsi's letter. He is not separated from his people, even in prison. The Alliance also affirms to all Egyptians, that it gave full opportunity for coup commanders and collaborators – over the past ten months – to retreat and accept the will of the people, of the Revolution and the revolutionaries, and to stop the coup terror that hit every home.


The door is still open for an exit from the crisis, by the putschists meeting the people's demands in full. Otherwise, let us all revolutionaries turn up in a massive demonstration on July 3 in a massive new wave of the Revolution to end military rule and the murderous military coup.


To all patriotic revolutionary men and women of Egypt...


The Revolution is your own. Stand firm and defend the truth. Escalate your non-violent revolt in new waves of rage against the coup. Make use of accumulated experience, the mechanisms of popular resistance and tactics of creative peaceful defiance. Youths and students should bravely be at the forefront in every rally.


Let's start with "The Generals Think It's a Fiefdom" week of revolutionary action Friday June 6 with continuous effective revolutionary action in every city, town and square, especially on the illegitimate 'inauguration day'. Meanwhile, we should start religious activities, the first of which will be fasting Thursday in solidarity with the champions of the battle of empty stomachs and the ongoing prison uprising. We should also commit to the continuation of the economic boycott of all collaborators with falsehood at home and abroad. Victory comes with patience.


Down with military rule…


The people have spoken: the coup must be overthrown.


The people do not recognize the coup... No negotiations on the Martyrs' blood.

Muslim Brotherhood to Al-Sisi: Election Wholly Null and Void

The Muslim Brotherhood issued the following statement regarding the recent illegitimate presidential elections:

On the anniversary of the 1967 (war with Israel) setback, which was the natural result of the army 's preoccupation with politics at the time, the presidential elections committee announced the result of the recent blood ballot farce – which was ridiculed all over the world, as all nations watched Egyptians' persistent boycott of the cheap soap opera in its entirety.


In this regard, the Muslim Brotherhood affirms the following:


First: This result will not change any coup realities on the ground. Needless to say, what is built on falsehood is false itself.


Second: Our great people, along with the whole world, know that the real ruler of Egypt since the coup is that same murderer, and that he is responsible for all the tragic events that hit the country, including political, economic and social destruction. He is also primarily responsible for the genocide executed ruthlessly by his security forces, the army, the police and the judiciary. All these are crimes with no statute of limitations. Very soon, the people of this homeland will hold fair and prompt trials for these crimes, for the murderous mastermind and all his political, military and judicial henchmen.


Third: The end of the presidential blood ballot is the beginning of the last round of the conflict between our great people – of whom more than 90% boycotted that farce – and the coup. The result of the conflict is well known beforehand. The people shall not be defeated.


The Muslim Brotherhood is confident that this round will not take long, God willing, with the patriotic revolutionaries' steadfastness, selfless devotion and ingenuity in their peaceful revolt as all Egyptians rally around them in every inch of this country.


Very soon, the people will celebrate the end to the coup and reclaim their freedom and independence of will.

Muslim Brotherhood leader: Al-Sisi is a 'tyrant'

The Supreme Guide of the Egyptian Muslim Brotherhood Mohammed Badie has accused the former Egyptian army commander and presidency candidate Abdel Fattah Al-Sisi of being a "military tyrant" and predicted that he will fail to stay in power.

From a cage in courtroom where he faces charges of inciting violence against the military-backed government, Badie said: "It does not make sense that we replace a civilian autocrat with a military tyrant. They are preparing Al-Sisi to take over power and we and the Egyptian people will never accept this."
He pointed out that "the violent military coup killed thousands of us and changed all the facts and accused us of terrorism. The Muslim Brotherhood has never accepted violence and never retaliated even when they killed our former supreme guide Hassan Al-Banna. I am a victim."

Badie accused Al-Sisi of endorsing and using terrorism, saying the current authorities have killed the Egyptian people.

The Brotherhood accuses the military backed government of practicing terrorism by arresting thousands of people and committing human rights violations.

One of the Muslim Brotherhood defendants, Jihad Haddad, who appeared in court yesterday, encouraged global powers to support democracy in Egypt. He said: "I say to world leaders who support democracy: now is the time to stand and end the military coup. We are fighting for the freedom of the country. We will continue to fight for freedom and will not surrender."

Egypt's Sisi in UAE for joint military exercises

Abu Dhabi (AFP) - Egyptian military chief Abdel Fattah al-Sisi arrived Tuesday in the United Arab Emirates, a strong supporter of his July ouster of Islamist president Mohamed Morsi.

Field Marshal Sisi, who is Egypt's defence minister and deputy premier, travelled to the UAE to attend the closure of joint military exercises there. He was met by UAE deputy army chief Sheikh Mohamed bin Zayed al-Nahyan.

The two men noted the "fraternal and solid relations linking the two countries and their peoples," and their wish to "consolidate bilateral cooperation," the WAM news agency reported, without giving details on Sisi's plans or the length of his stay.

The Emirates have given Egypt $4.9 billion in financial aid since Morsi's ouster, as well as deposited $2 billion in the Egyptian central bank, interest free.

Last week, the UAE joined Saudi Arabia and Bahrain in recalling their ambassadors from fellow Gulf Cooperation Council member Qatar over its support for Morsi's Muslim Brotherhood.

As a sign of support for the military-installed government in Cairo, the UAE's Arabtec contractor signed a memorandum of understanding Sunday to develop a $40 billion project to build one million housing units in Egypt.

The signing came ahead of an expected announcement by Sisi that he will run in elections to replace Morsi, a vote he is widely expected to win.

Sisi has emerged as the most popular political figure in Egypt following Morsi's troubled year-long rule, with many viewing him as a strong leader who can restore stability after three years of unrest unleashed by the 2011 revolt that toppled Hosni Mubarak.

Morsi tells Sisi: You shall be brought to account and severely punished

President Mohammed Morsi was today permitted to make a statement from within the detention cage inside the court, which is presided over by Judge Sha'ban Al-Shami, the head of Cairo criminal court - which is looking into the case of the storming of Wadi Al-Natroon Prison. He said: "Abdul fattah Al-Sisi, who presides over the military coup d'etat that took place in the country will be called to account before God and will also be tried before the entire people who will show in mercy to him. He will be punished several for what he did to the country. He mobiles the military, the army, inside the country without permission from the supreme commander of the armed forces. This is considered an abhorrent crime committed against this people."

The president sent his greetings to the Egyptian people saying: "My greetings to the entire people. I would like to say to you continue your peaceful demonstrations. I am with you. We shall prevail despite the conspirators who are allied with the Zionists." This is what the Middle News Agency reported.
